SURFERELLE TERMS & CONDITIONS

The Short Version

This summary is provided for convenience only. It is not part of the agreement and does not replace the full Terms below. Where the summary and the Terms differ, the Terms apply.

Membership billing and renewal. Membership plans are offered on a monthly or annual basis. The price and billing period that apply to you are the ones shown at checkout. Memberships renew automatically at the end of each billing period until you cancel. If we increase your renewal price, we will email you at least 7 days beforehand.

Founding member pricing. If you join during a founding-member or promotional period, the rate you signed up at is held for three years from the day you join, as long as your subscription stays continuously active. After that, your membership renews at our standard rate, and we will email you before the first charge at the new price. If your subscription lapses or is cancelled before the three years are up, the founding rate no longer applies. The three years is a price guarantee, not a commitment; you can still cancel at any time.

Cancelling. You can cancel at any time from your account settings. Cancelling stops future renewals; it does not refund the period you have already paid for. You keep access until the end of that period.

Refunds. Membership fees are generally non-refundable because you get immediate access to digital content. We do review requests individually and respond within 15 business days. Nothing here affects refund or cooling-off rights you have under the law where you live.

Digital products. One-time purchases such as e-books, guides, and programs are non-refundable once the file has been delivered, again subject to your statutory rights.

Surf trips. Most of our trips are sold and operated by World Surfaris Pty Ltd, not by Surferelle. When that is the case, your booking contract is with them and their booking, deposit, cancellation, and insurance conditions apply. Surferelle provides the coaching. Where a trip is sold directly by Surferelle, we say so on the trip page and our own booking terms in Section 8 apply. Comprehensive travel insurance is required for every trip either way.

Filming. We film and photograph extensively — it is part of how the coaching works, and you should expect to appear in footage used to coach you and the group. Using your image in our marketing is separate, and you can decline that at any time.

Surfing carries real risk. Surfing, ocean activities, physical training, and international travel involve inherent risks including serious injury and death. Participation is voluntary and at your own risk.

Welcome to Surferelle

We’re excited to be part of your surfing journey. Our goal is to provide high-quality coaching, education, community, and unforgettable surf experiences while creating a supportive environment for surfers of all abilities.

These Terms & Conditions (“Terms”) explain the rules that apply when you use Surferelle. They are designed to protect both you and us by clearly outlining our responsibilities, your responsibilities, and how our platform operates.

By creating an account, purchasing a membership, booking a consultation, joining a surf trip, downloading resources, participating in our community, or otherwise using any Surferelle product or service, you agree to these Terms.

If you do not agree with these Terms, you should not use the Surferelle platform or any services offered through it.

1. Who We Are

Surferelle is a coaching, education, and community platform designed to help surfers build confidence, improve their skills, and enjoy surfing through expert guidance, training resources, and shared experiences.

For the purposes of these Terms & Conditions, “Surferelle,” “we,” “our,” and “us” refer to Surferelle, a brand owned and operated by Gabrielle Sampiere, trading as Sampiere Lifestyles, a sole proprietorship.

Surferelle provides a variety of products and services, including but not limited to memberships, digital courses, downloadable resources, gym and surf training programs, consultation calls, coaching, surfboard and equipment recommendations, community platforms, affiliate partnerships, surf coaching trips, events, retreats, and any future products or services we may introduce.

Some services, including certain surf trips, are delivered in partnership with third-party providers, including World Surfaris Pty Ltd. Where third-party providers are involved, their own booking conditions, waivers, or policies apply in addition to these Terms. Section 8 explains how this works for surf coaching trips.

2. Scope of These Terms

These Terms apply to all current and future products and services offered by Surferelle, including but not limited to:

  • Memberships and subscriptions

  • Digital courses

  • E-books

  • Downloadable PDFs and guides

  • Gym training programs

  • Surf training programs

  • Video coaching

  • Online coaching

  • Consultation calls

  • Surfboard recommendations

  • Equipment recommendations

  • Private communities (including Discord and future community platforms)

  • Affiliate partnerships

  • Coaching resources

  • Surf coaching trips

  • Retreats

  • Events

  • Future products, services, features, software, or content introduced by Surferelle

These Terms continue to apply as our platform grows and new products or services are added.

Acceptance of These Terms

By accessing or using Surferelle, creating an account, purchasing a membership, booking a consultation or surf trip, downloading resources, participating in our community, or using any of our products or services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions, together with any additional policies or guidelines referenced throughout our platform.

If you do not agree to these Terms, you must not access or use Surferelle or any of our services.

You agree that your acceptance of these Terms by electronic means — including checking an acceptance box, creating an account, making a purchase, or otherwise using the platform — has the same legal effect as signing a written agreement.

These Terms apply to all visitors, members, customers, participants, contributors, and any other individuals who access or use Surferelle, regardless of whether they purchase a paid product or service.

By continuing to use Surferelle, you acknowledge that you are legally capable of entering into a binding agreement under the laws applicable to you and that you will comply with these Terms at all times.

3. Eligibility, User Responsibilities & Acceptable Use

Eligibility

You must be at least 18 years of age, or the age of majority in your jurisdiction if higher, to create an account, purchase a membership, book a consultation, participate in a surf trip, or otherwise use any Surferelle product or service.

By using Surferelle, you represent and warrant that:

  • You meet the age requirement above.

  • You have the legal capacity to enter into a binding agreement.

  • All information you provide to us is accurate, complete, and kept up to date.

  • You will use Surferelle only for lawful purposes and in accordance with these Terms.

  • You will not use our platform in any way that could harm Surferelle, its members, its partners, or other users.

Your Account

You are responsible for maintaining the confidentiality of your account credentials, including your username and password. You are responsible for all activity that occurs under your account.

If you believe your account has been accessed without your permission or your login credentials have been compromised, you must notify Surferelle as soon as reasonably possible.

You may use Surferelle only for your own personal, non-commercial purposes unless we have provided our prior written permission.

Acceptable Use

You agree that you will not:

  • Violate any applicable law, regulation, or legal obligation.

  • Breach these Terms or any other Surferelle policy.

  • Share, sell, transfer, lend, or otherwise provide access to your account or membership to another person.

  • Create multiple accounts to avoid restrictions, circumvent these Terms, or evade enforcement action.

  • Attempt to gain unauthorised access to any account, server, database, software, or restricted area of the platform.

  • Interfere with the security, stability, functionality, or operation of Surferelle.

  • Upload or distribute viruses, malware, ransomware, spyware, malicious code, or other harmful software.

  • Use bots, scripts, automated software, crawlers, or scrapers to collect, scrape, harvest, copy, or extract information, member data, or platform content without our written permission.

  • Attempt to reverse engineer, decompile, disassemble, copy, or reproduce any part of the platform or its underlying systems.

  • Circumvent security measures, access controls, payment systems, or technological protections implemented by Surferelle.

  • Record, reproduce, distribute, sell, licence, or commercially exploit Surferelle content, except as expressly permitted under Section 13.

  • Use Surferelle content to create competing coaching services, educational materials, memberships, courses, software, or businesses.

  • Misrepresent your identity, qualifications, or experience, or falsely claim an affiliation with Surferelle.

  • Upload content that infringes another person’s intellectual property, privacy, publicity, or other legal rights.

  • Introduce spam, chain messages, unsolicited advertising, or promotional material into any part of the platform.

  • Use Surferelle to harass, intimidate, threaten, defraud, deceive, or exploit another person.

  • Encourage unsafe surfing practices, illegal activities, or behaviour that may place another person at unreasonable risk.

  • Interfere with another member’s ability to enjoy or use the platform.

Restrictions relating to artificial intelligence, machine learning, and the training of models on Surferelle content are set out in Section 13.

Compliance & Enforcement

You are solely responsible for ensuring that your use of Surferelle complies with the laws and regulations applicable in your country or jurisdiction.

To the fullest extent permitted by applicable law, Surferelle reserves the right to investigate suspected breaches of these Terms and to take any action we reasonably consider necessary to protect the platform, our members, our intellectual property, or our business.

Failure to comply with these Terms may result in the suspension or permanent termination of your account, removal from community features, cancellation of bookings, restriction of access to Surferelle services, or other actions we consider appropriate to protect our business and community. Section 18 sets out how suspension and termination work.

Reporting Misuse

If you become aware of misuse of the platform, unauthorised sharing of Surferelle content, security vulnerabilities, fraudulent activity, or behaviour that may place members or the business at risk, we encourage you to notify us at elle@surferelle.com.

Protecting the Surferelle community is a shared responsibility, and we appreciate the support of members who help us maintain a positive, respectful, and secure platform.

4. Memberships & Subscriptions

Surferelle offers membership plans that provide access to exclusive educational content, coaching resources, community features, digital products, discounts, and other membership benefits.

Your membership grants you a limited, personal, non-exclusive, non-transferable, and revocable licence to access the content and services included in your membership level for the duration of your active subscription.

Membership benefits may include, but are not limited to:

  • Digital courses

  • Downloadable guides and PDFs

  • Gym and surf training programs

  • Educational videos

  • Community access (including Discord and future community platforms)

  • Live sessions or coaching opportunities

  • Priority or early access to surf trip releases and waitlists

  • Discounts on products, consultations, coaching, or surf trips

  • Exclusive member resources

  • Future features and benefits introduced by Surferelle

Changes to Membership Benefits

Membership benefits may change from time to time as we continue to improve and develop the platform.

We may add, remove, modify, replace, or discontinue content, features, tools, community platforms, educational materials, or membership benefits at our discretion. While we aim to continually improve the value of your membership, we do not guarantee that any particular feature, coach, community platform, lesson, resource, or benefit will remain available indefinitely.

Free Accounts

Surferelle offers free accounts that provide access to certain features of the platform, including creating a surf profile and applying for surf trips.

Free accounts are provided at our discretion. We reserve the right to change, limit, or discontinue the features available on a free account, to make features that are currently free available only to paying members, to introduce new paid tiers, and to close free accounts that have been inactive for an extended period. Where we close an inactive free account, we will make reasonable efforts to notify you beforehand at the email address associated with the account.

Access to a free account does not entitle you to any paid membership benefit, and nothing in this section requires Surferelle to continue offering free accounts.

Personal Use of Membership

Membership access is granted solely to the individual who purchased the membership.

Memberships may not be shared, transferred, assigned, resold, sublicensed, or used by multiple individuals under any circumstances.

Each member is responsible for maintaining the confidentiality of their account credentials. Sharing login details or allowing another person to access your account is a material breach of these Terms.

If we reasonably believe that an account is being shared, accessed by multiple users, or used in a manner inconsistent with these Terms, we reserve the right to investigate the activity and may suspend or terminate the account without prior notice or refund.

What Membership Does Not Include

Membership provides access to Surferelle’s educational platform and related services only. Purchasing a membership does not create an employment relationship, partnership, joint venture, agency relationship, or guarantee of ongoing coaching, consultation availability, or participation in surf trips.

Surferelle may occasionally offer bonus content, promotional offers, early access opportunities, or complimentary resources. Unless expressly stated otherwise, these bonuses are discretionary, may be withdrawn or changed at any time, and do not form part of the permanent membership benefits.

We reserve the right to refuse, suspend, or terminate memberships where necessary to protect the safety, integrity, reputation, security, or operation of Surferelle and its community, subject to any rights you may have under applicable law.

5. Membership Fees, Payments & Automatic Renewals

Membership fees are displayed on the Surferelle website at the time of purchase and are charged in the currency specified during checkout.

Membership Tiers & Billing Periods

Surferelle may offer one or more membership tiers. The features, price, and billing period (for example, monthly or annual) applicable to your membership are those disclosed to you at the time of purchase and confirmed in your order confirmation.

Surferelle may introduce, modify, rename, combine, or discontinue membership tiers at any time. Where we discontinue a tier you are subscribed to, we will notify you and you may move to another tier or cancel; you will not be charged for a tier you are no longer able to access.

Changing Tiers

You may upgrade or downgrade your membership where that option is made available. The effective date, any proration or credit, and the amount payable will be disclosed to you before you confirm the change. Downgrades take effect at the end of your current paid period unless we state otherwise.

Automatic Renewal

By purchasing a membership, you authorise Surferelle and its payment providers to charge your selected payment method for the full membership fee and to automatically renew your membership at the end of each billing period unless you cancel before your renewal date.

Your membership will continue to renew automatically at the end of each billing period until cancelled.

You are responsible for ensuring that your payment information remains accurate and up to date.

If a payment cannot be processed for any reason, Surferelle may suspend or terminate your access to paid membership features until payment has been successfully received.

Price Changes

Membership prices may change from time to time.

If your renewal price changes, the updated price will apply to future renewal periods only. We will notify you by email at least 7 days before any increase in your renewal price takes effect, and you may cancel before the increase applies. Where the law applicable to you requires a longer notice period or a different form of notice, we will comply with that requirement.

Founding Member & Promotional Pricing

Where you subscribe during a promotional or founding-member period, the rate disclosed at the time of purchase will apply to your renewals for three years from the start date of your membership, provided your subscription remains continuously active.

At the end of that three-year period your membership will renew at Surferelle's then-current standard rate for your tier and billing period. We will notify you by email before the first renewal at the standard rate, stating the new amount and how to cancel, in accordance with the notice periods set out under Price Changes above and any longer period required by the law applicable to you.

If your subscription lapses, is cancelled, or is terminated for any reason, the promotional rate no longer applies and any new subscription will be at the then-current standard rate.

The founding rate is a price guarantee only. It does not commit you to a minimum term, and you may cancel at any time as set out under Cancellation below.

Cancellation

You may cancel your membership at any time through your account settings or by contacting Surferelle. Where you purchased your membership online, you may cancel it online.

Cancellation prevents future automatic renewals only.

Cancelling your membership does not entitle you to a refund for the current membership period unless Surferelle expressly approves a refund under the Refund Policy below.

You will continue to have access to your membership benefits until the end of your current paid membership period. This applies where you cancel voluntarily. Where your access is suspended or terminated by Surferelle for breach of these Terms, Section 18 applies and access may end immediately.

Refund Policy

Because membership provides immediate access to digital content, educational resources, community features, downloadable materials, and other member benefits, membership fees are generally non-refundable once payment has been processed.

However, Surferelle understands that exceptional circumstances may arise.

Refund requests may be submitted by contacting elle@surferelle.com.

All refund requests are reviewed individually. Where a refund is approved, Surferelle may determine the refund amount after considering factors including, but not limited to:

  • The length of time the membership has been active.

  • Access to digital products and downloadable resources.

  • Participation in community features.

  • Discounts or member-only benefits already used.

  • Consultations or services already received.

  • Any other membership benefits already accessed.

Where applicable, approved refunds may be issued only for the unused portion of the membership period.

Approval of any refund request does not create an obligation or precedent to approve future refund requests.

We aim to respond to refund requests within 15 business days and will explain the basis for our decision. Nothing in this section affects any statutory refund, cancellation, or cooling-off rights you may have under the laws applicable to you.

Payment Disputes & Chargebacks

If you believe you have been charged in error, please contact us at elle@surferelle.com before initiating a chargeback or payment dispute with your bank or card issuer, so that we have the opportunity to review and resolve the issue directly.

Where a chargeback is initiated in respect of a charge that we reasonably believe to be valid, we may suspend access to your account and to any affected services while the dispute is under review, and may recover any resulting fees or costs from you to the extent permitted by applicable law.

Taxes & Payment Processing

Unless otherwise stated, prices do not include any taxes, duties, currency conversion fees, bank charges, or payment processing fees that may apply in your jurisdiction.

You are solely responsible for any additional charges imposed by your financial institution, payment provider, or local tax authority.

6. Consultations & Coaching Services

Surferelle offers consultations, coaching services, educational guidance, and other professional support designed to help surfers improve their skills, confidence, decision-making, equipment choices, training, and overall surfing experience.

Consultations may be provided online, in person, or through other communication methods offered by Surferelle.

While every effort is made to provide accurate, practical, and personalised guidance, all coaching and consultation services are educational in nature and should not be interpreted as medical, psychological, therapeutic, legal, financial, or professional advice outside the scope of surfing education.

Booking & Scheduling

Consultations are available by appointment only and are subject to availability.

Where a consultation requires review or approval before a session is confirmed, that process will be explained at the time you submit your request. Bookings are confirmed only after any required approval has been given and payment has been successfully received, unless otherwise agreed in writing.

Surferelle reserves the right to decline or reschedule consultation requests where necessary.

Rescheduling & Cancellations

Clients may reschedule a consultation by providing at least 48 hours’ notice through the designated booking platform or by contacting Surferelle directly.

Requests made with less than 48 hours’ notice may be treated as a late cancellation.

The consequences of a late cancellation or missed appointment, whether a purchased consultation may be cancelled for a refund, and any period within which a purchased consultation must be booked and used, are set out in the cancellation policy disclosed to you at the time of booking. That policy forms part of your agreement with us for that consultation.

If Surferelle needs to reschedule a consultation due to unforeseen circumstances, every reasonable effort will be made to arrange another suitable time.

Client Responsibilities

To receive the greatest benefit from coaching services, you agree to:

  • Provide accurate and honest information about your surfing experience, fitness level, injuries, goals, and any other relevant information.

  • Attend consultations prepared and on time.

  • Ask questions if recommendations are unclear.

  • Take responsibility for your own decisions and actions following any coaching or advice received.

Surferelle cannot provide accurate recommendations where incomplete, inaccurate, or misleading information has been supplied by the client.

No Guarantee of Results

Every surfer progresses differently.

Your improvement depends on many factors outside Surferelle’s control, including your experience, physical ability, consistency, health, equipment, environmental conditions, wave quality, frequency of practice, mindset, and commitment.

For this reason, Surferelle does not guarantee any specific level of surfing improvement, fitness outcome, competition result, wave count, confidence level, or other measurable result.

Any testimonials, examples, success stories, or case studies shared through Surferelle are provided for illustrative purposes only and should not be interpreted as guarantees of future performance.

Recording of Consultations

Unless expressly agreed in writing by Surferelle, consultations may not be recorded, reproduced, livestreamed, distributed, published, or shared in any form.

Where Surferelle records a consultation for educational, quality assurance, or training purposes, you will be notified where required by applicable law.

Submitted Coaching Footage

Where you submit your own surf footage, photographs, or other material to Surferelle for coaching review or feedback, that material is treated as Submitted Coaching Material and is subject to Section 14, which limits how we may use it.

Right to Refuse Service

Surferelle reserves the right to refuse, suspend, postpone, or terminate consultations or coaching services where necessary, including where a client:

  • Behaves abusively or disrespectfully.

  • Creates safety concerns.

  • Provides misleading information.

  • Repeatedly fails to attend scheduled appointments.

  • Breaches these Terms & Conditions.

  • Acts in a manner that negatively affects Surferelle, its community, or other participants.

Where services are refused or terminated due to a breach of these Terms, refunds may be withheld to the extent permitted by applicable law.

7. Digital Products & One-Time Purchases

Surferelle offers digital products for one-time purchase, including e-books, downloadable guides, PDFs, training programs, and other digital content (“Digital Products”).

Licence

When you purchase a Digital Product, you are granted a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use that product for your own personal, non-commercial use.

You may not copy, reproduce, republish, distribute, share, resell, licence, sublicense, upload to any file-sharing or content platform, or otherwise make a Digital Product available to any other person. You may not remove or alter any copyright notice, branding, watermark, or other identifying feature contained in a Digital Product.

Access & Delivery

Digital Products are delivered electronically. Download links or access credentials may be time-limited, and access may be provided through a member account or a third-party delivery platform.

You are responsible for downloading and retaining your own copy of any Digital Product within any stated access period. Where a download link has expired, we will usually be able to reissue it on request, but we do not guarantee indefinite availability of any Digital Product.

Refunds

Because Digital Products are delivered immediately and cannot be returned, all sales are final and Digital Products are non-refundable once the product has been delivered or the download made available.

Nothing in this section affects any statutory refund, cancellation, or cooling-off rights you may have under the laws applicable to you. Where you are a consumer in a jurisdiction that provides a right of withdrawal for digital content, that right and any acknowledgement required to waive it will be presented to you at the point of purchase.

Updates

We may update, revise, or replace Digital Products from time to time. Where we do so, we are not obliged to provide updated versions to previous purchasers, although we may choose to do so. # 8. Surf Coaching Trips

Surferelle offers surf coaching trips, retreats, camps, and hosted travel experiences in various destinations around the world, including but not limited to Indonesia, the Maldives, Nicaragua, and other international locations.

These trips are designed to provide coaching, education, community, and guided surf experiences. Destination availability, accommodation, itineraries, coaches, activities, and inclusions may vary from trip to trip.

8.1 Who Sells and Operates Your Trip

Surf coaching trips featured by Surferelle are provided in one of two ways:

  • Operator-sold trips. The trip is sold and operated by a third-party travel operator, currently World Surfaris Pty Ltd, and Surferelle provides surf coaching on that trip. Section 8.2 applies.

  • Surferelle-sold trips. The trip is organised and sold directly by Surferelle. Section 8.3 applies.

The relevant trip page identifies which of these applies to that trip, and your booking confirmation will confirm who you are contracting with. If it is not clear to you which arrangement applies to a trip you are considering, please ask us before booking.

Section 8.4 applies to all trips regardless of who sells and operates them.

8.2 Operator-Sold Trips

Where a trip is sold and operated by a third-party operator, your booking contract for all travel, accommodation, transport, and trip logistics is with that operator, and their booking conditions, deposit and cancellation policies, payment schedules, insurance requirements, and waivers apply to that booking.

Surferelle is not the seller or operator of these trips and does not accept bookings or payments for them. Surferelle cannot cancel, reschedule, or amend a booking made with a third-party operator.

You are responsible for reading and accepting the operator’s terms before booking. Where those terms conflict with these Terms in relation to travel, accommodation, transport, payment, or trip logistics, the operator’s terms apply to that booking.

Travel insurance. World Surfaris and other operators require comprehensive travel insurance as a condition of travel. Surferelle also requires it as a condition of participating in coaching, as set out in Section 8.4.

Surferelle provides surf coaching services on these trips. These Terms apply to the coaching services Surferelle provides.

8.3 Surferelle-Sold Trips

This section applies only where the trip page and your booking confirmation identify Surferelle as the seller of the trip.

Booking & Deposits

A booking is not confirmed until any required deposit has been received.

Deposits are due within the timeframe specified at the time of booking. Failure to pay a required deposit within the stated timeframe may result in your reservation being cancelled and your place offered to another participant.

Unless expressly stated otherwise in writing, deposits are non-refundable.

At Surferelle’s discretion, a deposit may be transferred toward a future Surferelle trip if you are unable to attend your original booking. Approval of one transfer does not create an obligation to approve future transfer requests.

Final Payments

The remaining balance must be paid by the final payment deadline communicated during the booking process.

Failure to make payment by the due date may result in cancellation of your booking without refund of any amounts already paid, unless otherwise agreed by Surferelle.

Inclusions & Exclusions

Inclusions and exclusions vary by trip and are set out on the relevant trip page. The inclusions listed on the trip page at the time of your booking form part of your booking agreement.

Unless expressly stated as included, all other costs — including international flights, airport transfers not listed, visas, travel insurance, equipment rental, gratuities, and personal expenses — are your responsibility.

Cancellation by You

If you choose to cancel your participation, the cancellation terms and any refund or credit available to you are those disclosed at the time of booking and confirmed in your booking confirmation.

Where cancellation occurs after the final payment deadline, refunds may not be available unless recoverable through your travel insurance provider.

Cancellation or Changes by Surferelle

Surferelle reserves the right to postpone, reschedule, modify, or cancel any Surferelle-sold trip where reasonably necessary, including but not limited to circumstances involving:

  • Severe weather or dangerous ocean conditions

  • Natural disasters

  • Government travel restrictions

  • Political instability

  • Civil unrest

  • Pandemics or public health emergencies

  • Safety concerns

  • Insufficient participant numbers

  • Instructor illness or unavailability

  • Circumstances beyond our reasonable control

Where we cancel a Surferelle-sold trip before departure, we will offer you a choice of a credit toward a future Surferelle trip, a place on a comparable alternative trip where one is available, or a refund of amounts paid to Surferelle for the trip. Where we make significant changes to a trip before departure, we will notify you and, where the change materially affects the trip you booked, offer you the same choice.

Where a trip is cut short or amended after departure due to circumstances beyond our reasonable control, any refund or credit will reflect the portion of the trip not delivered and the costs Surferelle is unable to recover.

Surferelle is not responsible for additional expenses incurred by participants, including flights, accommodation booked independently, visa expenses, equipment rentals, or other personal travel costs. This is one of the reasons comprehensive travel insurance is required.

Suppliers & Local Operators

Surferelle contracts with independent third-party suppliers to deliver elements of Surferelle-sold trips, including boat charters, vessel operators, accommodation providers, ground transport operators, guides, and local service providers.

These suppliers are independent businesses and are not employees, agents, or representatives of Surferelle. To the fullest extent permitted by applicable law, Surferelle is not liable for the acts, omissions, negligence, equipment, standards, or business practices of any such supplier, or for any loss, injury, damage, delay, or expense arising from them.

Suppliers’ own terms, conditions, and waivers may apply to services they provide, and you may be required to accept them directly.

Passport, Visa & Travel Requirements

Participants are solely responsible for ensuring they possess:

  • A valid passport

  • Any required visas

  • Vaccinations

  • Entry permits

  • Health documentation

  • Customs declarations

  • Any other travel requirements imposed by destination countries

Surferelle accepts no responsibility for denied entry, missed flights, immigration issues, or travel disruptions resulting from incomplete documentation.

8.4 Terms Applying to All Trips

The following applies to every trip on which Surferelle provides coaching, whether the trip is operator-sold or Surferelle-sold.

Mandatory Travel Insurance

Comprehensive travel insurance is mandatory for all Surferelle trips and is a condition of participating in Surferelle coaching.

Your policy should include, where available:

  • Trip cancellation

  • Medical treatment

  • Emergency evacuation

  • Surfing and water sports coverage

  • Personal liability

  • Lost or delayed baggage

  • Travel interruption

Failure to obtain suitable travel insurance may result in your participation being refused. Where a trip is operator-sold, the operator’s own insurance requirements also apply and may be more specific.

Surf Ability Requirements

Each Surferelle trip is designed for surfers of a particular ability level.

Participants are responsible for honestly communicating their surfing experience, confidence, fitness, and abilities before booking.

Surferelle reserves the right to determine whether a participant is suitable for a particular trip.

If, before or during the trip, Surferelle reasonably believes that a participant’s ability differs significantly from what was represented, or that participation may create a safety risk for themselves or others, Surferelle reserves the right to modify that participant’s activities or remove them from certain surf sessions or the remainder of the coaching programme where reasonably necessary.

Such decisions are made in the interest of participant safety and do not automatically entitle the participant to a refund.

Participant Responsibilities

Participants agree to:

  • Follow all safety instructions provided by Surferelle, coaches, guides, instructors, and local operators.

  • Respect local customs, laws, and communities.

  • Treat accommodation, equipment, vehicles, and facilities responsibly.

  • Behave respectfully toward coaches, staff, locals, and fellow participants.

  • Avoid conduct that places themselves or others at unnecessary risk.

Failure to do so may result in removal from coaching activities or termination of participation without refund. Where a trip is operator-sold, removal from the trip itself is a matter for the operator under their terms.

Weather & Ocean Conditions

Surfing takes place in natural environments that are inherently unpredictable.

Wave quality, swell size, tides, winds, currents, marine life, weather conditions, and other environmental factors are outside Surferelle’s control.

Surferelle cannot guarantee surf conditions, weather, wave quality, or the availability of any particular surf break during a trip.

Activities, schedules, coaching locations, and itineraries may be changed at any time where necessary for safety or operational reasons.

Coaching Risk

Surf coaching involves entering the ocean and undertaking physical activity in an unpredictable natural environment. The risks set out in Section 9 apply to all coaching provided by Surferelle on any trip, and you assume those risks as set out in that section.

Filming & Photography

Filming and photography of surf sessions is a core part of how Surferelle coaching works. Section 15 explains how media featuring you may be created and used, and how you may decline the use of your image in our marketing.

Acknowledgement

By participating in a Surferelle surf trip, you acknowledge that you have read and understood this section and agree to comply with these Terms, together with any additional waivers, policies, or agreements required by Surferelle, by a third-party operator, or by a local supplier.

9. Acknowledgement & Assumption of Risk

Surfing, ocean activities, physical training, travel, and adventure sports involve inherent risks that cannot be eliminated, even with proper planning, instruction, supervision, equipment, and safety precautions.

By accessing Surferelle, participating in our coaching, training programs, consultations, community, digital content, surf trips, or any other services we provide, you acknowledge and voluntarily accept these inherent risks.

You understand that participation is entirely voluntary and that you are solely responsible for deciding whether any activity is appropriate for your individual experience, physical condition, health, confidence, and abilities.

Inherent Risks

You acknowledge that surfing and related activities may expose you to risks including, but not limited to:

  • Drowning or near drowning.

  • Powerful waves and surf conditions.

  • Rip currents, undertows, and strong ocean currents.

  • Shore break and heavy surf.

  • Collisions with surfboards, reefs, rocks, sandbanks, jetties, boats, or other objects.

  • Collisions with other surfers or water users.

  • Marine life, including jellyfish, sea urchins, coral, sharks, stingrays, and other animals.

  • Cuts, bruises, lacerations, fractures, sprains, strains, dislocations, concussion, spinal injuries, paralysis, or death.

  • Sun exposure, dehydration, heat exhaustion, hypothermia, illness, allergic reactions, or infections.

  • Equipment failure or malfunction.

  • Slippery surfaces, transportation incidents, and accidents occurring during travel to or from surf locations.

  • Remote locations where emergency medical treatment may be delayed or unavailable.

  • Unpredictable weather, tides, swells, winds, and changing environmental conditions.

  • Risks associated with international travel.

This list is not exhaustive, and other known or unknown risks may exist.

Physical Training Risks

Gym programs, mobility exercises, strength training, stretching, conditioning, breathwork, and all other physical activities provided through Surferelle also involve inherent risks.

These risks include, but are not limited to:

  • Muscle soreness.

  • Muscle strains and tears.

  • Ligament injuries.

  • Joint injuries.

  • Falls.

  • Overtraining.

  • Cardiovascular events.

  • Aggravation of existing injuries or medical conditions.

You accept full responsibility for determining whether you are physically capable of participating in any training program.

Personal Responsibility

You acknowledge and agree that you are solely responsible for:

  • Assessing your own surfing ability.

  • Deciding whether conditions are safe for you.

  • Choosing appropriate equipment.

  • Following local laws and surf etiquette.

  • Following safety instructions.

  • Monitoring your own physical condition.

  • Seeking medical attention where necessary.

  • Knowing your own limits.

You agree that you will never knowingly participate in activities beyond your abilities or continue participating where doing so would create an unreasonable risk to yourself or others.

No Guarantee of Safety

Although Surferelle strives to provide quality coaching, education, guidance, and safety recommendations, we cannot eliminate the inherent risks associated with surfing or physical activity.

Participation in any Surferelle activity does not guarantee your safety, prevent injury, or eliminate risk.

Voluntary Participation

You acknowledge that you are participating voluntarily and freely accept all known and unknown risks associated with surfing, ocean activities, travel, physical training, coaching, and related activities.

You understand that injuries, illness, property damage, financial loss, permanent disability, or death may occur despite reasonable precautions.

You accept full responsibility for your decision to participate.

Assumption of Risk

To the fullest extent permitted by applicable law, you expressly assume all risks associated with your participation in any Surferelle service or activity, whether such risks are known or unknown, foreseeable or unforeseeable, and whether they arise from natural conditions, your own actions, the actions of other participants, or circumstances beyond Surferelle’s reasonable control.

Nothing in this section excludes or limits any liability that cannot lawfully be excluded under applicable law.

10. Health & Medical Disclaimer

Your health and safety are important to us. While Surferelle provides educational resources designed to help you improve your surfing, fitness, and overall performance, we are not medical professionals and do not provide medical advice, diagnosis, treatment, or healthcare services.

All information provided through the Surferelle platform — including coaching, consultations, gym training programs, surf training programs, videos, articles, downloadable resources, educational materials, community discussions, and recommendations — is intended for educational and informational purposes only.

Nothing provided by Surferelle should be interpreted as medical advice or relied upon as a substitute for professional medical care.

Consult Your Healthcare Provider

Before beginning any surf training program, strength program, mobility routine, exercise program, breathwork practice, rehabilitation exercise, or other physical activity provided through Surferelle, you should consult an appropriately qualified healthcare professional, particularly if you:

  • Have a pre-existing medical condition.

  • Have experienced previous injuries.

  • Have heart, respiratory, neurological, or musculoskeletal conditions.

  • Are pregnant or postpartum.

  • Are taking medication that may affect physical activity.

  • Have been advised to limit physical exercise.

  • Have any concerns regarding your physical ability to participate safely.

By participating in any Surferelle program, you confirm that you believe you are physically capable of participating or have obtained appropriate medical advice before doing so.

Exercise at Your Own Risk

Participation in any physical activity involves inherent risks.

You acknowledge that you are solely responsible for determining your own physical limits and for modifying, stopping, or avoiding any activity that causes pain, discomfort, dizziness, fatigue, or any other concerning symptoms.

You should never continue an exercise, surf session, or training activity if you believe it may place your health or safety at risk.

Injury & Medical Responsibility

You accept full responsibility for any injury, illness, aggravation of an existing condition, or other health issue arising from your participation in any Surferelle activity, except where liability cannot legally be excluded under applicable law.

You are responsible for obtaining appropriate medical treatment whenever necessary.

Surferelle does not supervise your individual exercise sessions, surf sessions, or independent training and cannot monitor whether activities are performed correctly or safely.

Individual Results May Differ

Every individual responds differently to physical training, coaching, exercise, nutrition, recovery, and surfing.

Recommendations that are appropriate for one person may not be suitable for another.

You acknowledge that all decisions regarding your participation, training intensity, equipment, recovery, and progression remain your own responsibility.

Emergency Situations

If you experience chest pain, difficulty breathing, loss of consciousness, severe allergic reactions, suspected concussion, significant injury, or any other medical emergency while participating in physical activity, discontinue the activity immediately and seek appropriate emergency medical care.

No Medical Relationship

Your use of Surferelle does not create a doctor-patient, therapist-client, physiotherapist-patient, dietitian-client, or any other healthcare professional relationship between you and Surferelle, Gabrielle Sampiere, or any Surferelle coach, contractor, or representative.

11. Surfboard & Equipment Recommendations

One of Surferelle’s services includes providing educational guidance and recommendations regarding surfboards, fins, wetsuits, accessories, training equipment, and other surfing-related products.

These recommendations are intended to help members make informed decisions based on the information available at the time and should be considered educational guidance rather than guarantees of performance or suitability.

Personalised Recommendations

Where Surferelle provides personalised equipment or surfboard recommendations, those recommendations are based on the information you provide, including but not limited to:

  • Your surfing ability.

  • Height and weight.

  • Fitness level.

  • Experience.

  • Age (where relevant).

  • Typical surf conditions.

  • Surf goals.

  • Existing equipment.

  • Any other information you choose to provide.

You acknowledge that inaccurate, incomplete, or misleading information may affect the suitability of any recommendation.

No Guarantee of Performance

Surfboard and equipment selection is influenced by numerous factors that are beyond Surferelle’s control, including changing surf conditions, wave type, skill progression, individual preferences, manufacturing differences, equipment condition, and personal technique.

Accordingly, Surferelle does not guarantee that any recommended surfboard, fin setup, wetsuit, accessory, training aid, or other equipment will produce any particular surfing outcome, level of enjoyment, comfort, performance, or progression.

Individual experiences will vary.

Independent Purchasing Decisions

All purchasing decisions remain entirely your own.

You are under no obligation to purchase any equipment recommended by Surferelle.

Surferelle is not responsible for the availability, quality, manufacturing standards, shipping, delivery, defects, warranties, sizing, pricing, performance, or suitability of products supplied by third-party manufacturers, retailers, distributors, or brands.

Any concerns regarding purchased products should be directed to the relevant manufacturer or seller.

Equipment Safety

You are solely responsible for ensuring that your equipment is appropriate for your ability, maintained in safe working condition, and suitable for the conditions in which it will be used.

You should inspect your equipment regularly and discontinue use of any equipment that is damaged, unsafe, or no longer fit for its intended purpose.

Product Information

From time to time, Surferelle may discuss, review, compare, demonstrate, or recommend products, brands, or equipment.

Such information reflects our professional opinions and experience and is provided for educational purposes only.

Manufacturers may change product specifications, designs, materials, dimensions, pricing, or availability without notice.

Surferelle does not warrant that any product descriptions, specifications, or information provided by third parties are complete, accurate, or current.

Affiliate Relationships

Some equipment recommendations may include affiliate links or partnerships with brands we know and trust. Section 17 sets out how affiliate relationships work and how they are disclosed.

12. Community Guidelines & Member Conduct

Surferelle is built on respect, encouragement, learning, and a shared passion for surfing. Our community is intended to be a welcoming environment where members can ask questions, share experiences, celebrate progress, and support one another.

By participating in any Surferelle community feature — including Discord, private groups, discussion forums, live chats, comments, member events, or any future community platform — you agree to contribute in a respectful and constructive manner.

Community Standards

You agree to:

  • Treat all members, coaches, moderators, partners, and staff with courtesy and respect.

  • Respect differences in experience, ability, background, culture, identity, and opinion.

  • Encourage positive discussion and constructive feedback.

  • Communicate honestly and respectfully.

  • Follow any additional community rules published within individual community spaces, including Discord servers or future platforms.

Community-specific rules form part of these Terms and may be updated from time to time. Where they conflict with these Terms, these Terms apply.

Discord & Third-Party Community Platforms

Our community currently operates on Discord, which is an independent third-party platform that Surferelle does not own or control.

By joining our Discord server or any other third-party community platform we use, you agree that:

  • You must independently comply with that platform’s own terms of service and community guidelines, in addition to these Terms.

  • Surferelle is not responsible for the availability, performance, security, moderation decisions, outages, data handling, or account actions of that platform, including any suspension or ban imposed by the platform itself.

  • Access to member-only community spaces is linked to your Surferelle membership. Where your membership lapses, is cancelled, or is terminated, your access to member-only community areas will be removed automatically, and you may lose access to previous conversations and content in those areas.

  • You are responsible for maintaining your own account on that platform.

Surferelle may change or replace the community platform we use at any time.

Prohibited Conduct

You agree not to:

  • Harass, bully, intimidate, threaten, or abuse other members.

  • Engage in discrimination, hate speech, or offensive behaviour.

  • Post defamatory, obscene, sexually explicit, violent, or otherwise inappropriate content.

  • Share another person’s private or confidential information without their permission.

  • Spam, advertise, solicit business, or promote unrelated products or services without Surferelle’s prior written permission.

  • Upload malware, harmful software, or malicious links.

  • Misrepresent your identity, qualifications, or experience.

  • Encourage unsafe surfing, training practices, or illegal activity.

  • Disrupt discussions or intentionally create conflict within the community.

  • Circumvent moderation decisions by creating new accounts or using another person’s account.

Community Moderation

Surferelle reserves the right to monitor, moderate, edit, hide, restrict, or remove content posted within any community feature where reasonably necessary to maintain a safe, respectful, and productive environment.

We are not obligated to monitor all community activity and do not guarantee that all inappropriate content will be identified or removed immediately.

Removal from Community Features

If you breach these Terms or the rules of a specific community platform, Surferelle may temporarily or permanently remove your access to that community feature.

Removal from a community feature does not automatically cancel your membership or entitle you to a refund.

Where appropriate, Surferelle may also suspend or terminate your membership or access to other services if your conduct significantly impacts the safety, wellbeing, or experience of other members or the operation of the platform.

Responsibility for Community Content

Members are solely responsible for the content they post, upload, or share within Surferelle communities.

Surferelle does not endorse, guarantee, or accept responsibility for opinions, advice, recommendations, or statements made by members or third parties within community spaces.

Members should use their own judgment before relying on information shared by other users.

Reporting Concerns

If you believe a member has breached these Terms or community guidelines, we encourage you to report the issue to Surferelle by contacting us at elle@surferelle.com.

We will review reports in good faith and take action where we consider it appropriate.

Our Goal

Our goal is to foster a community where surfers of all abilities feel supported, respected, and inspired to learn. We ask every member to help us maintain that environment by treating others with kindness, professionalism, and respect. # 13. Intellectual Property

Surferelle has invested significant time, expertise, creativity, and resources into developing its educational content, coaching methods, digital resources, branding, and platform.

Unless otherwise stated, all content made available through Surferelle is owned by or licensed to Surferelle and is protected by applicable copyright, trademark, intellectual property, and other laws.

Nothing in these Terms transfers ownership of any intellectual property to you.

Our Intellectual Property

Surferelle’s intellectual property includes, but is not limited to:

  • The Surferelle name, logo, branding, graphics, and visual identity.

  • Website design and platform layout.

  • Educational videos and coaching content.

  • Surfboard recommendation frameworks and methodologies.

  • Training programs and coaching systems.

  • Gym programs and fitness resources.

  • Articles, blog posts, guides, worksheets, and downloadable PDFs.

  • Digital courses.

  • Audio recordings.

  • Photographs, illustrations, graphics, and designs.

  • Community resources.

  • Written materials.

  • Software, tools, databases, and platform functionality.

  • Any future educational content, products, services, or intellectual property developed by Surferelle.

Limited Licence

When you purchase a membership or access Surferelle content, you are granted a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the content for your own personal, non-commercial use.

This licence does not transfer ownership of any intellectual property.

Prohibited Uses

Unless expressly authorised in writing by Surferelle, you may not:

  • Copy, reproduce, duplicate, or republish Surferelle content.

  • Record coaching sessions or consultations.

  • Download, upload, distribute, share, sell, licence, sublicense, or commercially exploit any Surferelle content.

  • Share your membership login or allow another person to access paid content.

  • Modify, translate, adapt, reverse engineer, or create derivative works from Surferelle content.

  • Remove copyright notices, branding, or watermarks.

  • Use Surferelle content within another coaching business, educational platform, membership, or course.

  • Create competing products or services based on Surferelle’s content, coaching methods, systems, or educational materials.

  • Copy or reproduce Surferelle’s surfboard recommendation process, coaching methodology, training systems, frameworks, or proprietary educational approaches.

  • Scrape, harvest, extract, or systematically collect content or data from the platform.

  • Use bots, automated software, or artificial intelligence tools to copy, analyse, reproduce, or extract Surferelle content without our prior written permission.

  • Use Surferelle content, materials, coaching systems, videos, articles, PDFs, community discussions, or other intellectual property to train, develop, fine-tune, or improve artificial intelligence models, machine learning systems, large language models, datasets, or similar technologies without our express written consent.

Copyright Infringement

If you believe that content available through Surferelle infringes your intellectual property rights, please contact us at elle@surferelle.com with sufficient information for us to investigate the matter.

Likewise, if Surferelle reasonably believes that a member has infringed our intellectual property rights or those of a third party, we reserve the right to remove the content, suspend access to the platform, terminate memberships, pursue available legal remedies, or take any other action permitted by applicable law.

Reporting Unauthorised Use

If you become aware of unauthorised copying, distribution, sharing, resale, or misuse of Surferelle content, we encourage you to notify us at elle@surferelle.com.

Protecting our intellectual property helps us continue creating high-quality educational resources for the surfing community.

Reservation of Rights

All rights not expressly granted to you under these Terms are reserved by Surferelle.

Your purchase of a membership, consultation, course, surf trip, or any other Surferelle product does not grant you any ownership interest in Surferelle’s intellectual property.

14. User-Generated Content

Surferelle encourages members to share their surfing experiences, questions, progress, videos, photographs, comments, feedback, testimonials, and other content within our platform and community.

For the purposes of these Terms, “User-Generated Content” means any content you submit, upload, post, share, send, publish, or otherwise make available through Surferelle or any of its community features.

Submitted Coaching Material is treated separately and is not User-Generated Content. See “Submitted Coaching Material” below.

Ownership of Your Content

You retain ownership of the intellectual property rights in the content you create and share.

Nothing in these Terms transfers ownership of your original content to Surferelle.

However, by submitting User-Generated Content to Surferelle, you grant us the rights described below.

Licence Granted to Surferelle

By uploading or sharing User-Generated Content, you grant Surferelle a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to:

  • Store, host, reproduce, copy, and display your content.

  • Edit, crop, resize, format, and adapt your content where reasonably necessary.

  • Publish, distribute, promote, and publicly display your content.

  • Use your content in educational materials, coaching resources, presentations, social media, marketing campaigns, promotional materials, newsletters, and on the Surferelle website.

  • Use your content to improve, develop, operate, and promote Surferelle and its services.

This licence continues even if you later cancel your membership, except where prohibited by applicable law or where Surferelle agrees to remove specific content.

Submitted Coaching Material

“Submitted Coaching Material” means surf footage, photographs, or other material that you submit to Surferelle for the purpose of receiving coaching review, technique analysis, equipment advice, or personalised feedback — including through any video review or coaching submission service.

Submitted Coaching Material is not covered by the licence above. Instead, you grant Surferelle a limited, non-exclusive, royalty-free licence to store, reproduce, edit, annotate, and display that material solely for the purpose of providing coaching services to you, and for our own internal review, quality assurance, and coach training purposes.

Surferelle will not publish, distribute, or use Submitted Coaching Material in marketing, advertising, social media, or any public-facing content without your separate, express, opt-in consent. That consent may be given or refused at your discretion, and you may withdraw it at any time in respect of future use by contacting us at elle@surferelle.com.

Where you have given consent, we may use the material as described in that consent, and withdrawal of consent does not require us to remove material already published before your request.

What You Promise

By submitting User-Generated Content or Submitted Coaching Material, you represent and warrant that:

  • You own the content or have the necessary rights and permissions to share it.

  • Your content does not infringe another person’s intellectual property, privacy, publicity, or other legal rights.

  • The content is accurate to the best of your knowledge.

  • You have obtained permission from any identifiable individuals appearing in your content where required.

  • Your content does not contain unlawful, defamatory, abusive, discriminatory, fraudulent, misleading, or offensive material.

Community Content

You acknowledge that content shared by other members represents their own opinions and experiences.

Surferelle does not endorse, verify, or guarantee the accuracy of User-Generated Content posted by members.

You should exercise your own judgment before relying on advice, recommendations, or opinions shared within the community.

Our Right to Moderate

Surferelle reserves the right, but not the obligation, to review, edit, remove, restrict, refuse to publish, or otherwise moderate User-Generated Content where we reasonably believe it:

  • Breaches these Terms.

  • Violates applicable law.

  • Infringes another person’s rights.

  • Creates safety concerns.

  • Is misleading, offensive, abusive, or inappropriate.

  • Could harm the Surferelle community or business.

We may remove content without prior notice where we consider it reasonably necessary to do so.

Testimonials & Feedback

If you voluntarily provide reviews, testimonials, feedback, suggestions, success stories, survey responses, or recommendations about Surferelle, you agree that we may use, reproduce, publish, edit, and share that content for promotional, educational, marketing, or business purposes without additional compensation, unless otherwise agreed in writing.

Where practical, we may credit you by your first name, initials, social media handle, or other identifying information that you have publicly associated with your content, unless you request otherwise.

Removal Requests

If you wish to request the removal of User-Generated Content that you have shared with Surferelle, you may contact us at elle@surferelle.com.

While we will consider all reasonable requests in good faith, we cannot guarantee the removal of content that has already been incorporated into educational materials, marketing campaigns, archived publications, or other legitimate business uses prior to your request.

Respect for Our Community

By sharing content with Surferelle, you help inspire and educate surfers around the world.

We appreciate your trust and will always aim to use member content responsibly, respectfully, and in a manner consistent with the values of the Surferelle community.

15. Media Release & Use of Your Image

Surferelle regularly captures photographs, videos, audio recordings, testimonials, interviews, and other media during coaching sessions, surf trips, events, consultations, community activities, and other Surferelle experiences.

Filming and photography of surf sessions is a core part of how our coaching works. Reviewing footage of your own surfing is one of the primary ways we teach, and footage of group sessions is used in coaching reviews with other participants on the same trip or programme.

This section distinguishes between two different uses of media featuring you: coaching use, which is part of delivering the service, and promotional use, which is optional and which you may decline.

Coaching Use

By participating in any Surferelle coaching session, surf trip, or programme, you acknowledge and agree that photographs, video recordings, audio recordings, or other media featuring you will be created, and you grant Surferelle a worldwide, non-exclusive, royalty-free licence to record, store, reproduce, edit, annotate, and display that media for the purposes of:

  • Delivering coaching, video review, and feedback to you.

  • Delivering coaching and video review to other participants in the same session, trip, or programme.

  • Internal review, quality assurance, and coach training.

  • Retaining a record of the session.

Coaching use is integral to the service and cannot be separated from it. If you do not wish to be filmed at all, please contact us before booking so we can discuss whether the service is suitable for you.

Promotional Use

Separately, you grant Surferelle a worldwide, perpetual, non-exclusive, royalty-free licence to use, reproduce, edit, publish, distribute, display, adapt, and otherwise use your:

  • Photograph

  • Video recordings

  • Voice

  • Name or first name

  • Social media handle (where publicly associated with you)

  • Likeness and appearance

  • Testimonials, interviews, and statements

  • Surf and coaching footage

for legitimate business purposes, including but not limited to:

  • Marketing and advertising

  • Social media content

  • Website content

  • Educational resources

  • Online courses

  • Presentations

  • Newsletters

  • Printed materials

  • Promotional campaigns

  • Future products or services

  • Public relations

  • Business development

  • Historical archives documenting the Surferelle community

Declining or Withdrawing Promotional Use

You may decline promotional use of your image at any time.

If you would prefer not to appear in Surferelle’s marketing or public-facing content, please let us know in writing at elle@surferelle.com — ideally before your trip, session, or programme begins, so that we can plan around it. You may also withdraw your consent to promotional use at any time afterwards.

Where you decline or withdraw consent, we will stop using newly created media featuring you for promotional purposes, and will make reasonable efforts to avoid featuring you in promotional material produced after your request.

You acknowledge that:

  • We cannot guarantee that you will not appear incidentally in group photographs, wide shots, or footage of group activities, which are a normal part of surf trips and coaching sessions.

  • We cannot remove or recall media that has already been published, distributed, printed, incorporated into educational materials or marketing campaigns, or archived before your request, although we will consider reasonable requests to do so in good faith.

  • Declining promotional use does not affect coaching use as described above.

No Compensation

Unless otherwise agreed in writing, you acknowledge that you will not receive payment, royalties, compensation, or other financial benefit for the use of your image, likeness, voice, testimonials, or other media.

Editing & Production

You acknowledge that Surferelle may edit, crop, combine, enhance, subtitle, translate, shorten, or otherwise modify media for production, educational, marketing, or promotional purposes.

Except where you have declined or withdrawn consent to promotional use as described above, you waive any right to inspect or approve finished materials before publication.

Your Own Content

Nothing in this section prevents you from taking your own photographs or videos during Surferelle activities, provided that doing so:

  • Does not interfere with coaching or safety.

  • Does not infringe another person’s privacy.

  • Does not record or distribute paid educational content, consultations, coaching materials, or intellectual property in breach of these Terms.

Respect for Our Community

Surferelle is built around celebrating the surfing journey.

We aim to use member images, videos, and stories in a respectful, authentic, and positive way that reflects the values of our community and inspires surfers around the world.

16. Privacy & Data Collection

Your privacy is important to us.

Surferelle is committed to collecting, using, storing, and protecting your personal information responsibly and in accordance with applicable privacy laws.

By using Surferelle, you acknowledge that we may collect, process, and use your personal information as described in this section.

Information We May Collect

Depending on how you interact with Surferelle, we may collect information including, but not limited to:

  • Your name.

  • Email address.

  • Billing information.

  • Account details.

  • Membership information.

  • Surf experience and coaching information.

  • Health or fitness information you voluntarily provide.

  • Travel information relevant to surf trips.

  • Photographs, videos, testimonials, and other content you voluntarily submit.

  • Communications you send to us.

  • Website usage data.

  • Device information.

  • IP address.

  • Browser type.

By creating an account or purchasing a product or service, you agree that Surferelle may contact you regarding your account, bookings, memberships, purchases, payment confirmations, renewals, customer support, security updates, policy changes, and other service-related communications.

Where required by applicable law, you will have the opportunity to opt in to or opt out of marketing communications.

You may unsubscribe from promotional emails at any time using the unsubscribe link included in those communications.

Please note that opting out of marketing communications does not prevent us from sending essential service-related notices.

Third-Party Services

Surferelle uses trusted third-party service providers to help operate our business.

These providers may include payment processors, booking platforms, email marketing services, analytics providers, website hosting providers, community platforms, customer support software, and travel partners.

Where necessary to provide our services, your information may be shared with these providers, who are expected to handle your information in accordance with their own privacy practices and applicable laws.

Surferelle takes reasonable administrative, technical, and organisational measures to help protect your personal information.

However, no website, online platform, electronic storage system, or internet transmission can be guaranteed to be completely secure.

18. Account Suspension & Termination

Surferelle is committed to maintaining a safe, respectful, and positive environment for all members.

To protect our community, platform, intellectual property, business operations, and reputation, we reserve the right to suspend, restrict, or terminate access to our services where reasonably necessary and to the fullest extent permitted by applicable law.

Suspension of Access

Surferelle may temporarily suspend access to all or part of your account if we reasonably believe that you have:

  • Breached these Terms & Conditions.

  • Violated our Community Guidelines.

  • Shared your membership or login credentials.

  • Misused Surferelle content or intellectual property.

  • Failed to make required payments.

  • Engaged in fraudulent, unlawful, abusive, or deceptive conduct.

  • Created safety concerns during coaching sessions, surf trips, or community activities.

  • Interfered with the operation, security, or integrity of the platform.

  • Used the platform in a manner that could reasonably harm Surferelle, its members, partners, or reputation.

Where appropriate, we may investigate the matter before determining whether further action is necessary.

Termination of Membership

Where a serious or repeated breach of these Terms occurs, Surferelle may permanently terminate your membership or access to some or all of our services.

Examples may include, but are not limited to:

  • Repeated violations of community standards.

  • Unauthorised sharing, copying, or distribution of Surferelle content.

  • Attempting to reproduce or commercialise Surferelle’s intellectual property.

  • Harassment or abusive behaviour toward members, coaches, staff, or partners.

  • Fraudulent activity or payment fraud.

  • Circumventing account restrictions or creating multiple accounts to avoid enforcement.

  • Conduct that places yourself or others at unreasonable risk during coaching or surf trips.

  • Any other material breach of these Terms.

Community Access

Where appropriate, Surferelle may remove your access to specific community features — such as Discord or future community platforms — without terminating your overall membership.

Likewise, Surferelle may suspend access to consultations, coaching services, surf trips, or other individual services without cancelling your entire account where we believe such action is appropriate.

Effect of Termination

This section applies where Surferelle suspends or terminates your access. If you have cancelled your membership voluntarily, Section 5 applies and you retain access to your membership benefits until the end of your current paid period.

Upon suspension or termination by Surferelle:

  • Your right to access affected services ends immediately.

  • Your licence to use Surferelle content is revoked.

  • Your access to member-only community spaces, including Discord, will be removed.

  • You must cease using any restricted areas of the platform.

  • You must not attempt to create another account to avoid the suspension or termination.

  • Any provisions of these Terms that are intended to survive termination — including those relating to intellectual property, user-generated content, media releases, limitation of liability, indemnification, dispute resolution, and other continuing obligations — will remain in effect.

Refunds Following Suspension or Termination

Where an account is suspended or terminated because of a breach of these Terms, Surferelle is under no obligation to provide a refund for unused membership time, consultations, bookings, or other services, except where required by applicable law.

Your Right to Stop Using Surferelle

You may stop using Surferelle at any time.

However, termination of your account or cancellation of your membership does not automatically entitle you to a refund, release you from outstanding payment obligations, or affect any rights or obligations that arose before your account was closed.

Protecting Our Community

Our goal is always to resolve issues fairly and respectfully.

Where reasonably appropriate, Surferelle may choose to issue warnings, request corrective action, or work with members to resolve concerns before taking more serious enforcement action.

However, nothing in these Terms requires Surferelle to provide warnings before suspending or terminating access where immediate action is reasonably necessary to protect our community, business, or members.

19. Disclaimer of Warranties

Surferelle is committed to providing a high-quality coaching platform, educational resources, community, and surfing experiences. We continually work to improve our services and provide valuable content to our members.

However, to the fullest extent permitted by applicable law, Surferelle provides its website, platform, memberships, coaching, consultations, surf trips, digital products, community features, educational materials, and all related services “as is” and “as available.”

Except where prohibited by law, we make no warranties or representations, express or implied, regarding the operation, availability, accuracy, reliability, completeness, suitability, or performance of our services.

No Guarantee of Availability

While we strive to keep Surferelle available at all times, we do not guarantee that:

  • The platform will operate without interruption.

  • The website will always be available.

  • Services will be free from delays.

  • Errors or defects will never occur.

  • All technical issues can be corrected immediately.

  • Content will remain permanently available.

Temporary interruptions may occur due to maintenance, software updates, technical issues, internet outages, third-party service failures, security incidents, or circumstances beyond our reasonable control.

Educational Content

Surferelle makes reasonable efforts to provide accurate, current, and valuable educational information.

However, we do not warrant that all content will always be complete, accurate, error-free, current, or suitable for every individual or circumstance.

No Guarantee of Results

Because every individual is different, we cannot guarantee that Surferelle will meet every person’s expectations, preferences, goals, or desired outcomes, or that participation in any coaching, consultation, training program, or surf trip will produce any particular level of improvement, progression, performance, confidence, fitness, enjoyment, or achievement.

Your progress depends on factors outside our control, including your experience, consistency, health, previous injuries, frequency of practice, ocean conditions, equipment choices, mindset, and the decisions you make during and after coaching.

Testimonials, reviews, success stories, and examples of member experiences are shared to illustrate real experiences within the Surferelle community. They are not guarantees, promises, or predictions that you will achieve similar results.

Members are responsible for determining whether our services are suitable for their own circumstances.

Technical Performance

We do not warrant that:

  • The platform will be compatible with every device or browser.

  • Downloads will always be free from technical issues.

  • Third-party integrations will remain available.

  • Community platforms or external software will operate without interruption.

  • Internet connections or third-party services will perform reliably.

Third-Party Services

Nothing in these Terms excludes, limits, or modifies any warranty or consumer right that cannot lawfully be excluded under applicable law.

Continuous Improvement

Surferelle continually develops and improves its platform.

We reserve the right to update, modify, replace, suspend, or discontinue any feature, service, educational resource, coaching program, community platform, product, or other offering at any time, with or without notice, where reasonably necessary for the operation or improvement of our business.

20. Limitation of Liability

To the fullest extent permitted by applicable law, your use of Surferelle and participation in any of our products, services, coaching, consultations, training programs, surf trips, community features, educational resources, digital content, events, or activities is entirely at your own risk.

You acknowledge that surfing, ocean activities, physical training, travel, and adventure sports involve inherent risks, including the risk of serious injury, permanent disability, and death.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable law.

Limitation of Liability

To the fullest extent permitted by applicable law, Surferelle, Sampiere Lifestyles, Gabrielle Sampiere, and our employees, contractors, coaches, instructors, volunteers, affiliates, representatives, licensors, partners, and service providers shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or similar damages arising out of or relating to:

  • Your use of or inability to use the Surferelle platform.

  • Participation in coaching sessions, consultations, training programs, surf trips, or community activities.

  • Surfing or ocean-related activities.

  • Physical exercise, fitness programs, mobility training, or conditioning.

  • Equipment recommendations.

  • Third-party products or services.

  • Travel delays, cancellations, or disruptions.

  • Website interruptions, technical failures, or system outages.

  • Data loss or corruption.

  • Loss of profits, business opportunities, goodwill, or reputation.

  • Personal injury, illness, permanent disability, death, property damage, financial loss, emotional distress, loss of enjoyment, loss of opportunity, or any other loss or damage arising from or relating to your participation, except where liability cannot lawfully be excluded or limited under applicable law.

Decisions You Make

You acknowledge that all decisions you make based on information, coaching, recommendations, or educational materials provided by Surferelle are made voluntarily and at your own discretion.

You remain solely responsible for assessing your own surfing ability, physical condition, health, fitness, equipment, travel arrangements, surf conditions, weather, and personal circumstances before participating in any activity or acting upon any recommendation provided by Surferelle.

Third-Party Conduct

Surferelle is not responsible for the actions, omissions, conduct, negligence, products, or services of:

  • Other members.

  • Coaches or instructors acting outside the scope of their engagement with Surferelle.

  • Third-party travel providers and operators.

  • Boat charters, vessel operators, accommodation providers, and ground transport operators.

  • Equipment manufacturers.

  • Retailers.

  • Airlines.

  • Government authorities.

  • Independent contractors.

  • Other third parties.

Maximum Liability

To the fullest extent permitted by applicable law, if Surferelle is found legally liable for any claim arising from these Terms or your use of our services, our total aggregate liability shall not exceed the total amount you paid directly to Surferelle for the specific product or service giving rise to the claim during the twelve (12) months immediately preceding the event giving rise to the claim.

This limitation applies regardless of the legal theory on which a claim is based, whether in contract, tort (including negligence), statute, or otherwise, except where such limitations are prohibited by applicable law.

Your Responsibility

You acknowledge that the prices charged for Surferelle memberships, coaching services, consultations, surf trips, and other offerings reflect the allocation of risk between you and Surferelle.

You agree that the limitations contained in these Terms are reasonable, fair, and form an essential basis of the agreement between you and Surferelle.

Without these limitations, Surferelle would not be able to offer its services on the same terms or at the same price.

Survival

The limitations of liability contained in this section survive the suspension or termination of your membership and continue to apply after your relationship with Surferelle has ended, to the fullest extent permitted by applicable law.

21. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Surferelle, Sampiere Lifestyles, Gabrielle Sampiere, and our employees, contractors, coaches, instructors, volunteers, affiliates, licensors, representatives, partners, service providers, successors, and assigns from and against any claims, demands, actions, proceedings, liabilities, damages, judgments, settlements, losses, costs, expenses, and reasonable legal fees arising out of or relating to:

  • Your use of the Surferelle platform or any of our products or services.

  • Your participation in coaching sessions, consultations, surf trips, training programs, community activities, or other Surferelle experiences.

  • Your breach of these Terms & Conditions.

  • Your violation of any applicable law or regulation.

  • Your infringement of another person’s intellectual property, privacy, publicity, contractual, or other legal rights.

  • User-Generated Content that you upload, post, publish, or otherwise share through Surferelle.

  • Your negligent, reckless, fraudulent, unlawful, or intentional acts or omissions.

  • Your misuse of Surferelle’s platform, intellectual property, coaching materials, or educational resources.

  • Your interactions or disputes with other members, third-party providers, travel operators, or other users of the platform.

Your Responsibility

You agree to cooperate fully with Surferelle in the defence of any matter that is subject to this indemnification obligation.

Surferelle reserves the right, at its own expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us. In such circumstances, you agree to cooperate with our reasonable requests in connection with that defence.

No Limitation of Other Rights

The indemnification obligations contained in this section are in addition to, and do not limit, any other legal rights or remedies available to Surferelle under these Terms, applicable law, or otherwise.

Survival

Your obligations under this section survive the suspension or termination of your membership and continue after your relationship with Surferelle has ended, to the fullest extent permitted by applicable law.

22. Governing Law & Dispute Resolution

We genuinely hope that any concerns or disagreements can be resolved quickly, fairly, and respectfully.

If you have a question, concern, or complaint about Surferelle or any of our services, we encourage you to contact us first so that we have the opportunity to work with you toward a practical resolution.

Governing Law

These Terms & Conditions, together with any disputes or claims arising out of or relating to them or your use of Surferelle, are governed by and interpreted in accordance with the laws of the State of California, without regard to its conflict of laws principles.

Nothing in these Terms is intended to limit or exclude any consumer rights or protections that cannot legally be waived under applicable law.

Good Faith Resolution

Before commencing formal legal proceedings, both you and Surferelle agree to make a genuine effort to resolve any dispute through direct communication, and to participate in mediation with a private neutral mediator as a precondition to filing suit.

You agree to contact Surferelle with a written description of the issue and allow us a reasonable opportunity to investigate and respond before pursuing formal legal action, except where immediate legal relief is reasonably necessary.

The parties will share the mediator’s fees and administrative costs equally, and each party will bear its own legal costs in connection with the mediation. Nothing in this section requires either party to mediate where the applicable limitation period would expire, or where urgent injunctive relief is sought.

Venue

To the fullest extent permitted by applicable law, any legal proceedings arising out of or relating to these Terms or your use of Surferelle shall be brought exclusively in the state courts located in San Diego County, California (San Diego County Superior Court, North County Division), or, where federal jurisdiction exists, in the United States District Court for the Southern District of California.

You and Surferelle each consent to the personal jurisdiction of those courts and waive any objection to venue in them, except where mandatory applicable law requires otherwise.

International Members

Surferelle welcomes members from around the world.

By using our platform or participating in our services, you acknowledge that you are engaging with a business operated from the United States.

Nothing in this section limits any consumer rights that cannot lawfully be excluded under the laws applicable to you, including any right you may have to bring proceedings in the courts of your country of residence.

Time Limit for Claims

To the fullest extent permitted by applicable law, any claim arising out of or relating to your use of Surferelle or these Terms must be commenced within one (1) year after the claim arises, unless a longer limitation period is required by applicable law.

Injunctive Relief

You acknowledge that unauthorised use of Surferelle’s intellectual property, confidential information, coaching materials, educational resources, or proprietary content may cause harm that cannot be adequately compensated by monetary damages alone.

Accordingly, Surferelle may seek injunctive or other equitable relief, in addition to any other remedies available under applicable law, to protect its rights and interests.

23. Force Majeure

Surferelle will not be liable for any delay, interruption, failure to perform, cancellation, modification, or inability to provide any product, service, membership benefit, consultation, coaching session, surf trip, event, or other obligation under these Terms where such delay or failure is caused by circumstances beyond our reasonable control.

These circumstances may include, but are not limited to:

  • Severe weather or dangerous surf conditions.

  • Natural disasters, including earthquakes, floods, hurricanes, cyclones, tsunamis, volcanic activity, or wildfires.

  • Pandemics, epidemics, public health emergencies, or disease outbreaks.

  • Government actions, travel advisories, border closures, visa restrictions, sanctions, or changes in law.

  • Civil unrest, riots, terrorism, war, armed conflict, or political instability.

  • Airline cancellations, transportation disruptions, port closures, or other travel interruptions.

  • Power outages, internet failures, telecommunications failures, or cyberattacks.

  • Failure or interruption of third-party platforms, payment processors, booking systems, hosting providers, or other essential service providers.

  • Labour disputes, strikes, lockouts, or shortages of personnel.

  • Serious illness, injury, or unforeseen unavailability of key Surferelle personnel, coaches, or instructors.

  • Any other event or circumstance beyond Surferelle’s reasonable control that prevents or significantly interferes with the operation of our business or the delivery of our services.

Where a Force Majeure event occurs, Surferelle may, where reasonably appropriate:

  • Postpone or reschedule a service, consultation, event, or surf trip.

  • Modify itineraries, schedules, locations, coaches, accommodations, or activities.

  • Provide a credit toward a future service or event.

  • Suspend or temporarily limit access to certain services while the event continues.

  • Cancel affected services where performance is no longer reasonably possible.

Surferelle will make reasonable efforts to communicate significant changes as soon as practicable and to minimise disruption wherever possible.

Where a Surferelle-sold trip is cancelled due to a Force Majeure event, Section 8.3 sets out what we will offer you. Where an operator-sold trip is affected, the operator’s own force majeure and cancellation terms apply to your booking with them.

Except as set out in Section 8.3, nothing in this section requires Surferelle to provide refunds or compensation for losses, expenses, travel arrangements, accommodation, equipment, missed opportunities, or other costs arising from a Force Majeure event, except where required by applicable law or where Surferelle expressly agrees otherwise in writing.

Members and trip participants remain responsible for maintaining appropriate travel insurance and any other insurance they consider necessary to protect against losses resulting from events beyond Surferelle’s reasonable control.

Nothing in this section excludes or limits any rights or remedies that cannot lawfully be excluded under applicable law.

24. Changes to These Terms

Surferelle may update, revise, modify, or replace these Terms & Conditions from time to time to reflect changes to our business, services, platform, products, legal obligations, or operational practices.

When we make material changes, we will take reasonable steps to notify members where appropriate. Notification may be provided by email, through your account, by posting a notice on our website, or by any other reasonable method.

Where you hold a paid membership, material changes to these Terms will, where reasonably practicable, take effect from the start of your next renewal period rather than immediately, so that you have the opportunity to review them and cancel before they apply to you.

The most current version of these Terms will always be available on the Surferelle website, and the “Last Updated” date at the top of the document will indicate when changes were most recently made.

By continuing to access or use Surferelle after updated Terms become effective, you acknowledge and agree to be bound by the revised Terms.

If you do not agree with any updated Terms, you must stop using the Surferelle platform and, where applicable, cancel your membership before your next renewal.

No amendment or waiver of these Terms will be binding unless made in writing by an authorised representative of Surferelle.

Nothing in this section limits any rights you may have under applicable law where advance notice of changes or additional consent is required.

25. General Provisions

Entire Agreement

These Terms & Conditions, together with any additional policies, waivers, booking conditions, guidelines, or other documents expressly incorporated by reference, constitute the entire agreement between you and Surferelle regarding your access to and use of our platform, products, services, memberships, consultations, coaching, surf trips, community features, and related offerings.

These Terms supersede all prior or contemporaneous discussions, communications, representations, understandings, negotiations, proposals, or agreements relating to the same subject matter, whether oral, written, electronic, or otherwise.

You acknowledge that, in entering into this agreement, you have not relied upon any statement, representation, promise, or warranty that is not expressly set out in these Terms, except where such reliance cannot lawfully be excluded under applicable law.

Order of Precedence

These Terms incorporate or refer to other documents. Where there is a conflict between them, the following order of precedence applies, from highest to lowest:

  1. Any mandatory requirement of applicable law that cannot be excluded or varied by agreement.

  2. The booking conditions, waivers, and terms of a third-party trip operator, in relation to travel, accommodation, transport, payment, and trip logistics for a trip that operator sells and operates.

  3. Any signed waiver, release, or booking agreement you have entered into with Surferelle in relation to a specific trip, service, or event.

  4. These Terms & Conditions.

  5. Community rules published within individual community spaces, including Discord.

  6. Any other guideline, policy, or information published on the Surferelle website.

Where a conflict relates to a matter dealt with specifically in a lower-ranked document and not addressed in a higher-ranked one, the specific provision applies.

Severability

If any provision of these Terms is found by a court or other competent authority to be invalid, unlawful, or unenforceable in whole or in part, that provision will, to the extent required, be deemed modified to the minimum extent necessary to make it valid and enforceable, or if that is not possible, severed from these Terms.

The invalidity, unlawfulness, or unenforceability of any provision will not affect the validity or enforceability of the remaining provisions, which will continue in full force and effect.

Assignment

You may not assign, transfer, sublicense, or otherwise deal with your rights or obligations under these Terms without our prior written consent.

Surferelle may assign, transfer, or novate its rights and obligations under these Terms, in whole or in part, to any successor entity, affiliate, or acquirer of all or substantially all of its business or assets, including on any change in the legal structure of the business. We will take reasonable steps to notify you where such a transfer materially affects your rights.

Notices

Notices to you will be sent to the email address associated with your account and are deemed received on the day sent. You must keep your contact details current and ensure that emails from Surferelle are not blocked or filtered.

Notices to Surferelle, including any written notice required under Section 22, must be sent to elle@surferelle.com and are deemed received two business days after sending.

Waiver

No failure or delay by Surferelle in exercising any right or remedy under these Terms shall operate as a waiver of that right or remedy.

Any waiver of a provision of these Terms shall be effective only if it is made in writing and signed or otherwise expressly authorised by an authorised representative of Surferelle.

No Partnership or Agency

Nothing in these Terms creates any partnership, joint venture, employment, franchise, or agency relationship between you and Surferelle.

Survival

Any provision of these Terms which by its nature is intended to survive termination — including those relating to intellectual property, user-generated content, media releases, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution — will survive the termination or expiry of your membership or your use of Surferelle.

Consumer Rights

Nothing in these Terms affects any rights or remedies that cannot legally be excluded or limited under applicable law, including any statutory consumer guarantees, refund rights, or cooling-off rights available to you in your country of residence.
